Terms of Service

1. Acceptance of Terms

By accessing and using the PracticeSafe training platform ("Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.

2. Service Description

PracticeSafe provides online workplace safety training, induction programs, and certification services. Our service includes:

  • Access to video-based training modules
  • Interactive assessments and quizzes
  • Certification upon successful completion
  • Progress tracking and course resumption
  • Certificate validation and verification services

3. User Accounts

To access our services, you must:

  • Create an account with accurate and complete information
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access
  • Be at least 18 years old or have parental/guardian consent
  • Use your real name and contact information

You are responsible for all activities that occur under your account. Account sharing is strictly prohibited.

4. Payment and Pricing

Certificate fees are displayed in Australian Dollars (AUD) and are non-refundable except as required by Australian Consumer Law. Current certificate price is $70.00 AUD per module.

Payment is processed securely through Stripe. By providing payment information, you represent that you are authorized to use the payment method.

Prices may change with 30 days notice. Existing purchases are not affected by price changes.

5. Module Access and Validity Period

When you purchase a module:

  • Access Period: You receive 12 months of access to the module content from the date of purchase
  • Free Retakes: You may retake tests unlimited times at no additional cost during the 12-month access period
  • Access Expiration: After 12 months from purchase, you must repurchase the module to regain access
  • Certificate Validity: Certificates are valid for 12 months from the date of issue (separate from access period)

Example: If you purchase a module on January 1, 2025, you can access it and retake tests for free until January 1, 2026. If you pass on January 15, 2025, your certificate expires on January 15, 2026. To renew your certificate after it expires, you must repurchase the module.

6. Certificates and Verification

Certificates issued by PracticeSafe:

  • Are valid for 12 months from the date of issue
  • Require passing the assessment with the minimum passing score
  • Include a unique validation code for verification
  • May be verified by employers and authorities via our public verification system
  • Must be renewed by retaking the course after expiry

You are responsible for ensuring your certificates remain valid for your employment or regulatory requirements.

7. Intellectual Property

All content on the Service, including training materials, videos, assessments, text, graphics, logos, and software, is the property of PracticeSafe or its content suppliers and is protected by Australian and international copyright laws.

You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material on our Service except as necessary for your personal, non-commercial use.

8. Prohibited Conduct

You agree not to:

  • Share account credentials or allow others to use your account
  • Record, copy, or distribute course content without permission
  • Forge or manipulate certificates or validation codes
  • Attempt to bypass payment or assessment systems
  • Use automated systems to access the Service
  • Interfere with the Service's operation or security
  • Upload malicious code or attempt to hack the system
  • Impersonate others or provide false information

Violation of these terms may result in immediate account termination and legal action.

9. Limitation of Liability

To the maximum extent permitted by law, PracticeSafe shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, or other intangible losses.

Our liability for any claim arising from use of the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and obtain a refund for the unused portion, or to compensation for the reduced value of your services. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure is not a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

11. Disclaimer

While we strive to provide accurate and current information, PracticeSafe:

  • Does not guarantee that training content meets all specific regulatory requirements in all jurisdictions
  • Recommends verifying training requirements with your employer or relevant authority
  • Provides educational content for general information purposes
  • Does not replace hands-on training or workplace-specific safety procedures

12. Termination

We reserve the right to terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Service will immediately cease. Previously issued certificates will remain valid for their original validity period.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Queensland, Australia, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of Queensland.
